Overview and scope
This Privacy Policy explains how Fylm TV, Inc., doing business as Fylm TV ("Fylm TV," "we," "us," or "our"), collects, uses, discloses, retains, and protects personal information through FylmTV.com, film and festival submissions, forms, email and mobile messaging, events, affiliated Fylm TV communities, and future streaming and creator services (collectively, the "Services"). It also explains choices and rights that may be available to you.
A third-party service that you use to interact with us, such as FilmFreeway, Stripe, Facebook, Discord, or Google, may separately collect information under its own privacy policy. This Policy covers Fylm TV's handling of information received from or through those services, not the third party's independent practices.
Information we collect
Information you provide
- Identity and contact information, such as name, email address, postal or billing address, telephone number, age or age range when needed, and communication preferences.
- Account and security information, such as username, encrypted or hashed password, authentication information, and account recovery details when accounts become available.
- Film, festival, and creator information, such as a film or project file or screener link; title; metadata; description; category; credits; cast and crew; rights holders and owners; posters, trailers, stills, biographies, eligibility information, licenses, releases, and review or selection history.
- Transaction information, such as the product or submission purchased, amount, date, currency, discount or waiver, billing contact, processor transaction identifier, refund, dispute, and chargeback status. Complete payment-card information is handled by Stripe or another payment processor and is not intended to be stored by Fylm TV.
- Participation and communication information, such as waitlist registration, forms, survey answers, support messages, reviews, comments, event registration, sponsorship inquiries, consent records, and email or SMS preferences.
- Future platform activity you choose to provide, such as profile information, uploads, public posts, job or community activity, donations, merchandise activity, and monetization or tax information.
Information collected automatically
- Technical information, including IP address, device type, operating system, browser type and version, device or cookie identifiers, language, approximate location derived from IP, referring page, and network or error information.
- Usage information, including pages viewed, links clicked, forms started or completed, sign-up source, sessions, feature interactions, likes and dislikes, purchases, donations, and engagement with messages.
- Behavioral and watch data when streaming launches, including titles or categories viewed, playback position, watch duration, search and browse activity, ratings, saves, recommendations, ad interactions, and viewing device.
- Security and integrity information, including login events, failed attempts, fraud indicators, suspected abuse, moderation signals, and audit logs.
Information from other sources
We may receive information from FilmFreeway and other submission platforms; Stripe and other payment processors; Google Analytics and cookie technologies; event, form, email, cloud, and messaging providers; Fylm TV-owned or operated communities; referral partners; social networks when you choose to connect or communicate through them; and public or professional sources used to verify rights, identity, credits, or eligibility.
How we use information
- Provide the current Services, including the landing page and pre-launch list, process and review film or festival submissions, administer fees, discounts and waivers, communicate decisions, and manage events.
- Create and secure accounts; authenticate users; prevent fraud, piracy, abuse, and unauthorized access; enforce terms; investigate incidents; and protect users, rights holders, Fylm TV, and the public.
- Respond to requests, provide support, send administrative, transaction, submission, event, security, and legal communications, and maintain communication preferences.
- With consent where required, send newsletters, festival announcements, platform updates, surveys, and promotional email or text messages.
- Understand site and campaign performance, troubleshoot, test, conduct research, and improve design, accessibility, features, curation, and marketing.
- Verify eligibility, ownership, authority, licenses, credits, and compliance; maintain review, award, festival, rights, transaction, and audit records.
- Comply with law, tax, accounting, sanctions, legal process, and regulatory requests; establish, exercise, or defend legal claims.
- Support a corporate transaction, financing, audit, due diligence process, or transition of the Services subject to appropriate safeguards.
Future streaming, personalization, and creator tools
If and when those features launch, we may use account, interaction, and viewing data to provide playback, remember progress, personalize the experience, recommend films, measure content performance, provide aggregated or de-identified insights to creators and partners, administer subscriptions, donations and purchases, and calculate monetization under separate creator terms. We will update this Policy and obtain any consent required before materially different processing begins.
AI and automated processing
Fylm TV may use submission metadata, credits, descriptions, public promotional materials, review outcomes, platform activity, and aggregated or de-identified behavioral and watch data to train, test, validate, and improve internal models and automated tools for film discovery, recommendations, moderation, fraud and piracy detection, audience insights, content performance, valuation, and acquisition readiness. We may retain de-identified training datasets, aggregate statistics, evaluation results, and model parameters for long-term research and product improvement, provided we do not attempt to re-identify the data.
Fylm TV will not use a full private film, screenplay, or other nonpublic creative work to train a general-purpose or externally available AI model unless the creator gives a separate, clear authorization or a content license permits that use. We will not use personally identifiable viewing histories to train a third party's general-purpose model or allow a third party to use that information for its own purposes without separate informed permission when required. Automated tools may also be used to detect fraud or piracy, moderate content, categorize films, improve accessibility, and support internal workflows, subject to contractual and technical safeguards.
Advertising and analytics
We currently use Google Analytics and cookies or similar technologies to understand traffic, site use, and campaign performance. Fylm TV does not currently sell personal information or share it for cross-context behavioral advertising. We may use contextual advertising when streaming launches. If we introduce targeted advertising based on activity across unaffiliated services, we will update this Policy and provide notices, consent choices, and opt-out mechanisms required by law.
We will configure analytics and advertising tools not to receive information that directly identifies a person together with the specific video titles that person watches unless the disclosure is lawful and covered by a separate, informed Video Privacy Protection Act consent. We will not place third-party advertising pixels on authenticated watch-history or playback pages without completing that review and consent flow.
How we disclose information
We may disclose personal information to the following categories of recipients for the purposes described in this Policy:
- Service providers that host or secure systems, deliver email or SMS, process forms and submissions, analyze site use, provide customer support, store files, moderate content, or support events. Current examples may include FilmFreeway, Stripe, Google Analytics, and Amazon Web Services.
- Authorized reviewers, judges, festival staff, contractors, venues, and advisors who need information to evaluate or administer a submission, event, or requested service and are subject to appropriate duties or restrictions.
- Creators and partners, primarily through aggregated or de-identified audience and performance information. Public profile information, reviews, or interactions may be visible to others when you choose to publish them.
- Professional advisors, insurers, auditors, financing sources, and transaction counterparties subject to confidentiality or other safeguards.
- Law enforcement, regulators, courts, rights holders, or other parties when we reasonably believe disclosure is required or permitted to comply with law, protect rights or safety, investigate fraud or infringement, or enforce agreements.
- A successor or participating party in a merger, financing, acquisition, reorganization, bankruptcy, or transfer of all or part of the business, subject to applicable law.
Fylm TV does not sell or rent mobile numbers. No mobile numbers will be shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. We may use a messaging service provider solely to deliver and administer Fylm TV messages, subject to restrictions on using that information for another purpose.
Video-viewing privacy
When streaming launches, specific video-viewing history linked to an identifiable consumer will be treated as sensitive operational information. Fylm TV will not knowingly disclose that linked viewing information to a third-party advertising network or unrelated third party unless the disclosure is permitted by law or the consumer gives separate, informed electronic consent that is distinct from general cookie consent and can be withdrawn as provided in the consent flow.
Creators, sponsors, and business partners may receive aggregated, statistical, or de-identified performance information, such as total views, completion rates, broad audience segments, or engagement trends. They will not receive a viewer's identity tied to that viewer's specific watch history unless the viewer separately directs or authorizes the disclosure or law permits it.
Email and mobile messaging choices
You may unsubscribe from marketing email using the link in the message. Transaction, security, submission, ticket, and legal messages may continue when necessary for a requested service or relationship. For the Fylm TV mobile messaging program, message frequency varies, up to 4 messages per month; message and data rates may apply; reply STOP to cancel or HELP for help. Consent to marketing texts is not a condition of purchase. We maintain records of consent and opt-out requests as described below.
Data retention
There is no single lawful maximum for every category of data. We retain personal information for as long as reasonably necessary for the disclosed purpose, including operating and improving the Services and permitted internal AI systems, as well as contractual and licensing obligations, security, disputes, accounting and tax, legal compliance, and enforcement. The following are our intended operating periods; a longer or shorter period may apply when required by law, a legal hold, a rights agreement, or a documented business need.
- Waitlist and marketing contacts: Until unsubscribe or up to 3 years after the last meaningful interaction.
- Email/SMS consent and opt-out records: Generally at least 5 years after the last message, consent event, or opt-out.
- Rejected submission screeners/files: Ordinarily deleted or access-restricted within 90 days after the review and appeal period.
- Submission metadata, decisions, permissions, and payment records: Generally 7 years after the submission or event.
- Accepted or licensed content: For the term of the applicable license and any wind-down period; rights, payment, and compliance records may be kept for 7 years after the relationship ends.
- Accounts and profiles: While active and generally up to 3 years after closure.
- Transaction, accounting, and tax records: Generally 7 years.
- Identifiable viewing history: Destroyed as soon as practicable and no later than 1 year after it is no longer necessary, as applicable under the VPPA.
- De-identified AI datasets and model artifacts: May be retained long term for research and product improvement.
- Google Analytics and similar event-level data: Generally up to 14 months where configurable.
- Support, safety, and security logs: Generally 2 years.
- Backups: Generally within 90 days after deletion from active systems.
Your privacy rights and choices
Depending on where you live and subject to legal exceptions, you may have the right to request access to, correction of, deletion of, or a portable copy of personal information; learn about categories of information collected and disclosed; withdraw consent; appeal a denied request; and opt out of sale, targeted advertising, or certain profiling. Fylm TV intends to offer a practical baseline access, correction, and deletion process even when a specific state privacy law does not yet apply because of company size.
Submit a request to privacy@fylmtv.com. Please describe the request and the email, account, submission, or mobile number involved. We may verify identity and authority before responding. An authorized agent may submit a request where law permits, but we may require proof of authorization. You may appeal a denied request by replying to our decision with "Privacy Appeal" in the subject line. We will not unlawfully discriminate against you for exercising a privacy right.
We may deny or limit a request when necessary to protect another person's rights, comply with law, complete a transaction, maintain required tax or legal records, preserve evidence, detect security incidents or fraud, exercise free-expression rights, or retain de-identified information that cannot reasonably be linked back to you.
Children’s privacy
The Services are not directed to children under 13, and Fylm TV does not knowingly collect personal information online from a child under 13 without verifiable parental consent. General accounts require users to be at least 13. Film submissions, licenses, purchases, sponsorships, and monetization require a person who is at least 18 or the age of majority, unless completed by or with an authorized parent, guardian, or representative.
If you believe a child under 13 provided personal information to Fylm TV, contact privacy@fylmtv.com. We will investigate and delete the information or take other action required by law.
Security
Fylm TV uses administrative, technical, and physical safeguards designed to protect personal information, including access controls, authentication, encryption where appropriate, vendor controls, monitoring, and data-minimization practices. No system or transmission is completely secure. You are responsible for protecting account credentials and promptly reporting suspected unauthorized access.
International users and data transfers
Fylm TV is based in the United States. If you submit information from another country, it may be transferred to, stored in, and processed in the United States and other locations where our service providers operate. Privacy laws in those locations may differ from those where you live. Where required, we will use an appropriate transfer mechanism and process information on a recognized legal basis, such as performance of a contract, legitimate interests, consent, or compliance with law.
Changes to this Policy
We may update this Policy as the Services, vendors, data uses, or law change. We will post the revised Policy and effective date and will send email or provide other additional notice when a change is material or law requires it. An updated Policy may apply to previously collected information after the effective date when the new use is compatible with the original context and permitted by law. If a materially different use requires a new notice, opt-out opportunity, or affirmative consent, we will provide it before beginning that use.
